Should current employees be afraid of getting involved in this lawsuit?

No. The law prohibits Securitas Security Services USA, Inc. from taking any action against you for joining this lawsuit.  If you believe Securitas Security Services USA, Inc. has retaliated against you in any way, contact us immediately.

Do I need to pay any attorney’s fees to join the lawsuit?

No.  Gibbons Jones, P.C. will represent you on a contingency basis.  If a Court determines you are entitled to recovery for unpaid overtime, then attorneys' fees will be paid by Securitas Security Services USA, Inc. as a percentage of the recovery, in an amount approved by the court.  If the case is not successful, you will not owe any attorney’s fees. 

Why do you believe Securitas Security Services USA, Inc. did not pay overtime correctly?

The law requires that employees be paid for all time they are permitted to work. Based upon our investigation, we believe that Securitas Security Services USA, Inc. did not pay for all the time employees worked or for all time employees were permitted to work over 40 hours in a week.  We base this belief on the fact that security guards at Securitas Security Services USA, Inc. are required to perform pre- and/or post-shift briefings called "Passdowns" for which they remain unpaid.  We also base this belief on the fact that security guards at Securitas Security Services USA, Inc. often complete training materials while off-the-clock, and that those hours also remain unpaid.  Securitas Security Services USA, Inc. has not agreed or conceded that it did not pay overtime correctly.  In addition, no court has determined whether Securitas Security Services USA, Inc. pays overtime correctly.

What types of jobs or job titles are involved?

Uniformed Security Guards, or any employee that works as a security guard who performs pre- or post-shift Passdowns, or completes training material or exercises while off-the-clock and unpaid. 

Do I have any deadlines I need to worry about, or can I wait to see what happens with this case?

Yes.  Under federal overtime law, employees are generally not entitled to their lost overtime pay for hours they worked more than two (or three) years ago. In other words, once you join the lawsuit, you can only collect lost wages under Federal Law for two (or three) years prior to that date, nothing more.  The Court will determine whether the two year or three year deadline applies.

How can I tell if I qualify for this lawsuit?

If you are/were employed as a uniformed security guard for Securitas Security Services USA, Inc. in the last three (3) years, you may qualify to participate in the action. However, the Court will have to make that determination.
