FACTORY CARD & PARTY OUTLET OVERTIME LAWSUIT

If you are currently employed or have been employed during the last three years by Factory Card & Party Outlet (“FCPO”) and you worked as an Assistant Merchandise Manager, you may be entitled to unpaid overtime wages. 

FACTORY CARD & PARTY OUTLET OVERTIME LAWSUIT FILED

On April 24, 2007, two FCPO Assistant Merchandise Managers filed a lawsuit against FCPO on behalf of themselves and all present and former Assistant Merchandise Managers  who worked for FCPO during the three (3) year time period preceding the lawsuit.  The lawsuit alleges that FCPO improperly classified Assistant Merchandise Managers as exempt from overtime and that FCPO failed to pay it Assistant Merchandise Managers for all overtime hours that they worked. 

On or about April 27, 2008, FCPO reclassified the Assistant Merchandise Manager position as eligible for overtime.  On a going forward basis, FCPO will be paying all Assistant Merchandise Managers overtime. This lawsuit seeks a Court order requiring FCPO to pay Assistant Merchandise Managers for all overtime hours worked during the 3 year period prior to filing the lawsuit.

If you are a current or former Assistant Merchandise Manager and did not receive overtime pay for all hours worked in excess of forty in a week, you may be entitled to back-wages.  At this point in time, however, the Court has not made any determination concerning the scope of the class or whether FCPO is liable for any back pay or damages.
